Extract from the general conditions of sale, article “Withdrawal” :

The customer has 14 days to exercise their right of withdrawal without having to pay any penalties, except for return shipping costs. This period starts from the day the customer receives the items.

The return request can be made by contacting the customer service of the company Abitare SARL, either via the contact form or by email at the address . Items sold in sales, promotions and private sales can only be the subject of a credit note.

In the event of an exchange or refund, the new item(s) must be returned in its original packaging, intact (it must not have been worn or used, nor have suffered any deterioration, however minimal, and be in a perfectly clean condition) accompanied by all possible accessories, instructions for use and documentation to the following address:

Any product that is damaged, incomplete, or whose original packaging is damaged, will not be refunded or exchanged.

Abitare SARL suggests that the Customer return their products by registered Colissimo with additional insurance for the market value of the products, guaranteeing, where applicable, compensation for the products up to their actual market value in the event of theft or loss of the goods. In all cases, the return is at the Customer's risk. It is the customer's responsibility to retain all proof of return.

The company Abitare SARL recommends that the Customer/consumer over-pack the original packaging of its products.

This right of withdrawal is exercised without penalty, with the exception of transport costs which remain the responsibility of the Customer. In the event of exercising the right of withdrawal, the Customer has the choice of requesting either a refund of the sums paid, or an exchange of an amount equivalent to the sums paid or, where applicable, with a bank supplement, the re-shipping costs remaining the responsibility of the Customer.

In the event of a total or partial refund, Abitare SARL will make every effort to reimburse the consumer for the amounts paid by him, free of charge, with the exception of return costs, within a maximum of 15 days. However, given the technical nature of certain products sold, this period may be extended to 45 days, particularly when the product requires technical verification (these products must be tested beforehand). The consumer will be reimbursed by crediting his bank account (secure transaction) in the case of payment by credit card, or by check in other cases. For this purpose, the customer will provide Abitare SARL with his bank details.

All orders placed with Abitare SARL are intended for the personal use of customers; customers or recipients of the products are prohibited from any partial or total resale of the products.

The products are delivered to the address indicated by the customer on the order form.

The customer must verify the completeness and accuracy of the information provided to Abitare SARL. The latter cannot be held responsible for any data entry errors and their consequences in terms of delays or delivery errors. In this context, all costs incurred for the reshipment of the order will be entirely borne by the customer. Similarly, Abitare SARL cannot be held responsible for delivery delays due to errors or disruptions attributable to carriers (total or partial strike, in particular of postal services and means of transport and/or communications).

The products offered for sale are either available from stock, or the availability period is specified on the product sheet and confirmed in the order description.

In the event of a stock shortage or unavailability of the ordered product, Abitare SARL undertakes to inform the customer as soon as possible and to specify a timeframe for availability. The customer will confirm by email their choice of either waiting for the product to become available or receiving a refund.

Small Parcels

Preparation and dispatch of small parcel orders (excluding furniture and bedding): In the case of purchasing products in stock, the day after order confirmation at the latest, the order is entrusted to the carrier. This carrier undertakes, by contract with Abitare SARL, to deliver the order to the buyer's address provided by Abitare SARL.

Delivery of small parcel orders: For single orders of products excluding furniture and bedding and in stock, delivery is made in mainland France by Chronopost within a maximum of 3 working days from the confirmation of dispatch of the order which is sent to you by email.

Furniture, Bedding

Preparation of furniture orders: After confirmation of the order, in the case of purchase of products in stock, Abitare SARL undertakes to deliver to its carrier all the references ordered by the buyer within a maximum period of 5 working days. This carrier undertakes, by contract with Abitare SARL, to deliver the order to the buyer's address provided by Abitare SARL.

Furniture delivery: The average delivery time for furniture is 5 working days (excluding preparation days). Any postponement times related to the appointment date made and accepted with and by the customer cannot be included in these delivery times.

Multi-product order

When the Customer orders several products at the same time and these have different shipping times, the order shipping time is based on the longest time.

In the case of an order that includes one or more unavailable products as well as one or more available products, Abitare SARL will ship the order upon receipt of all the products that make up the order. If the Customer wishes to receive the immediately available products as quickly as possible, they are advised to isolate these items in a separate specific order.

Special cases

For availability reasons, Abitare SARL may choose to deliver an order to the customer in several installments. The customer then only pays for one delivery.

If the customer wants 2 different delivery locations, he must place 2 orders, with the associated delivery costs.

Transfer of risks

The transfer of risks to the customer occurs as soon as the products are handed over by Abitare to the carrier. In all cases, the product(s) ordered therefore travel at the customer's risk.

Delivery is made to the customer by handing over the product directly to the recipient indicated, or in the event of absence, to another person authorized by the customer. In the event of the recipient's absence at the time of delivery, the carrier will leave a calling card at the delivery address indicated by the customer. The products must be collected from the address and according to the terms indicated by the carrier. In the event of non-collection within the time limits set by the carrier, the products will be returned to Abitare, which reserves the right to refund the price, with the shipping costs remaining the responsibility of the customer. Any delays do not entitle the buyer to claim damages.

Upon delivery, the customer must, in the presence of the carrier or postal employee, check the condition of the package, the contents, the conformity and the condition of the product(s) before signing the acknowledgment of receipt of the package. If the customer notices any anomalies concerning the delivery (damage, product missing from the delivery note, damaged package, broken product, etc.), he must refuse delivery of the products or issue handwritten reservations on the delivery note. These reservations must be precise, detailed, dated and accompanied by the customer's signature. These reservations must be confirmed to the carrier by registered letter with acknowledgment of receipt within three (3) working days following delivery of the product(s). In the case of a technical product, the customer will take particular care to check the proper functioning of the delivered device and to read the instructions provided. In the event of an apparent defect, the buyer has the right to return the product under the conditions provided in this document.

In the event of an error in the product, the customer undertakes to return the said product or products concerned within 14 days of receipt to Abitare SARL at the following address without opening their packaging, in their original condition and packaging and with the accompanying documents:

To be accepted, all returns must be reported in advance to Abitare SARL Customer Service by email to contact@abitare-living.lu. The return number given to the Customer must appear visibly on the return packaging and the printed return slip, slipped inside the package.

During the withdrawal period mentioned in Article 10 below, the customer is responsible for the item as custodian. In the event of deterioration or destruction of the product while in the customer's custody, the latter will bear all the consequences.

The delivery slip dated and signed by the customer upon delivery of the product will constitute proof of transport and delivery.

If the Customer fails to meet its obligations, it will bear, without recourse against Abitare SARL, any damage linked to anomalies and/or damage noted on the delivery and will not be able to challenge the sale and payment of the price. Any claim received after the deadline will be rejected.

All products sold by Abitare SARL are put into service and/or assembled by the Customer, under the latter's sole responsibility.

Neither party will have failed in its contractual obligations, to the extent that their execution is delayed, hindered or prevented by a fortuitous event or force majeure.

Any irresistible, unforeseeable, unavoidable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts, shall be considered as fortuitous event or force majeure. The party affected by such circumstances shall notify the other within 10 working days following the date on which it becomes aware of them. The two parties shall then come together, within 1 month, unless impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued.

If the force majeure event lasts for more than 3 months, these general conditions may be terminated by the injured party. The following are expressly considered to be cases of force majeure or unforeseeable circumstances, in addition to those usually recognized by the case law of Luxembourg courts and tribunals: the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning; the shutdown of telecommunications networks or difficulties specific to telecommunications networks external to customers.

This contract is subject to Luxembourg law.

Abitare SARL cannot be held liable for damages of any kind, whether material, immaterial or physical, which may result from malfunction or misuse of the products sold. The same applies to any possible modifications to the products resulting from the manufacturers.

The liability of Abitare SARL will, in any event, be limited to the amount of the order and cannot be called into question for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products.

In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of a professional association, a consumer association or any other advisor of his choice. It is recalled that the search for an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the assessment of the courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments to the seller.

Complaints or disputes will always be received with kindness and attention, good faith always being presumed in those who take the trouble to explain their problem. In the event of a dispute, the Customer will contact the company as a priority to obtain an amicable solution.

Failing this, the Luxembourg Court shall have sole jurisdiction, regardless of the place(s) of delivery and the method of payment accepted.

In all cases, Abitare SARL cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the country of receipt. The liability of Abitare SARL is systematically limited to the value of the product in question, value on its date of sale, without any possibility of recourse against the brand or the company producing the product.

In any event, the customer benefits from the legal guarantee of eviction and hidden defects. Provided the buyer proves the hidden defect, the seller is legally obliged to repair all the consequences; if the buyer goes to court, they must do so within a "short period" of time from the discovery of the hidden defect. The validation “click” constitutes an electronic signature.

Any order form signed by the consumer by “clicking” to validate constitutes an irrevocable acceptance which can only be challenged in the cases strictly provided for in these T&Cs.

The "double click" associated with the authentication and non-repudiation procedure and the protection of the integrity of messages constitutes an electronic signature. This electronic signature has the same value between parties as a handwritten signature.

The computerized records, kept in the computer systems by Abitare SARL under reasonable security conditions, will be considered as proof of communication, orders and payments between the parties.

The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.
